I would say that if the licence conditions specify recording "at the time of broadcast" or similar then it doesn't need a licence if the BBC loaded iPlayer from the master disc or tape and didn't record the programme off air. After all it happened at a different time and I don't class it as a broadcast.
I'm sure TVL would put the interpretation on it that got them what they wanted.
